内容記述 | We indicated the questionable organic relationship between the legal requirements for and the evaluation methods of a request for rent increase/decrease regarding the judgment of unreasonableness in Article 11 of the Act on Land and Building Leases in the current judiciary. We constructed a theory to organically link the judgment of unreasonableness with the rent appraisal by dividing the circumstances of a request for rent increase/decrease concerning legal requirements into “objective circumstances” and “subjective circumstances” and separating real circumstances into “change of circumstances” and “various circumstances” in court precedents. Subsequently, we elucidated a theory to explain the effect of rent increase/decrease, which was judged to be unreasonable due to the legal requirements, on property values called leaseholds or tenancies. In 2022, we reexamined rights inherent in ownership and the property value of each right before investigating the abovementioned organic relationship. We clarified the evaluation mechanism of explaining the specific effects of the rights to freely use, profit from, and dispose of the thing owned, which are the contents of ownership stated in Article 206 of the Civil Code, on actual real estate and value formation related to the specific effect. We understood the property values of various real estate-related rights by analyzing legal procedures to separate the rights to use and profit, which are part of real estate ownership, from real estate ownership. We also investigated the continuance of a right and the consolidation of rights. To understand the value of ownership, from which the rights to use and profit had already been separated, we confirmed the necessity of dividing profits from real estate into “revenue” and “income” and analyzing the revenue and income. When ownership is divided into the rights to use and profit and the right to dispose, the ownership value before the division (called perfect ownership) may be smaller than the sum of the rights to use and profit and the right to dispose after the division: A loss due to partition may occur in property. Finally, we elucidated a legal action (partition of ownership) to generate a loss, which was organically related to the appraisal losses of owners’ property values and recognized highly skilled professionals’ bligation to accurately evaluate and point out the loss due to partition and its causal legal action. |
