内容記述 In Japan, many buildings built in the post-war period (particularly sturdy buildings) are experiencing deterioration due to the passage of 60 years. When considering rebuilding of buildings and effective utilization of owned land, a crucial legal issue—particularly for commercial districts—is ongoing adjustments in leases with existing tenants. This research focuses in particular on the problem of evicting tenants in commercial districts, and mainly concerns rights adjustment and monetary transfers.
This is the "problem of refusal to renew (eviction and temporary payment problem)" in Article 28 of the Act on Land and Building Leases. In combination with building deterioration, this has even become a significant social problem at some locations when there is no leeway in terms of time (i.e., when there is even the possibility of partial collapse, depending on the building situation). A solution to this is provided by clarifying the relationship between the "justifiable grounds" that are a requirement for refusal to renew a building lease contract, and the "payment of monetary considerations (compensation for eviction)" that is positioned as a complementary element.
To clarify the relationship between "refusal to renew (decision to evict)" and "the amount of compensation for eviction," investigation is needed with a focus on "tenant rights," which are the main constituent content of payment of monetary considerations (compensation for eviction). Based on this study research, this paper reports an organic relationship between the judgment criterion (justifiable grounds) and the amount of compensation for eviction (payment of monetary considerations) which is particularly useful in court.
